Terms & Conditions

1. Acceptance of Terms

Welcome to Pyaau.

These Terms & Conditions (“Terms”) govern your access to and use of the Pyaau website, mobile applications, and related services (collectively, the “Platform”).

The Platform is operated by Emajdoor IT Solutions (“Pyaau”, “we”, “our”, or “us”).

By creating an account, subscribing to, or using Pyaau, you agree to these Terms and our Privacy Policy.

If you are using the Platform on behalf of a business, you confirm that you are authorized to accept these Terms on that business’s behalf.

If you do not agree with these Terms, you must not use the Platform.

2. Description of Services

Pyaau is a subscription-based software platform designed for businesses engaged in water jar and drinking-water delivery operations.

Depending on the subscribed plan and available functionality, Pyaau may provide:

  • Customer management
  • Delivery and order management
  • Water jar quantity tracking
  • Payment and outstanding balance tracking
  • Business income and expense records
  • Operational reports
  • Staff accounts and access management
  • Other business management features introduced from time to time

Pyaau is a software technology provider. We do not manufacture, sell, distribute, or deliver drinking water on behalf of businesses using the Platform.

All commercial transactions between a water delivery business and its customers remain the responsibility of that business.

3. Eligibility and Account Registration

To use Pyaau, you must:

  • Be at least 18 years old
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate registration information
  • Maintain the confidentiality of your login credentials
  • Use the Platform for lawful business purposes

You are responsible for activity performed through your account and authorized staff accounts.

You must notify us promptly if you suspect unauthorized access or misuse.

4. Subscriptions and Billing

4.1 Subscription Plans

Pyaau may offer free trials, promotional access, or paid subscription plans.

Available features, subscription duration, usage limitations, and fees will be communicated during registration, purchase, or renewal.

4.2 Subscription Fees

Subscription fees are payable according to the plan selected by the business.

Applicable taxes may be charged in addition to the displayed subscription price unless otherwise stated.

4.3 Renewal

Subscriptions may be renewed manually or automatically, depending on the selected payment and billing arrangement.

Where automatic renewal is offered, the renewal terms, charges, and cancellation process will be disclosed before the user authorizes recurring billing.

4.4 Price Changes

We may revise subscription prices from time to time.

Price changes will not alter the fees already paid for an active subscription period.

Updated prices will apply to subsequent subscriptions or renewals following appropriate notice.

4.5 Trial and Promotional Offers

Pyaau may provide free trials or promotional subscription periods.

Trial duration, eligibility, and applicable restrictions will be communicated when the offer is made.

We reserve the right to modify or discontinue promotional offers for future subscriptions.

5. Cancellation and Refunds

Businesses may choose not to renew their subscriptions.

Unless otherwise stated at the time of purchase, subscription fees already paid are generally non-refundable once the paid subscription period has started.

Refunds may be considered in cases of duplicate payments, incorrect charges, or verified billing errors.

Nothing in these Terms restricts any refund or other remedy that is mandatory under applicable law.

Cancellation of a subscription does not automatically remove previously recorded business data.

Account closure and data deletion will be handled according to our Privacy Policy and applicable retention requirements.

6. User Responsibilities

Businesses using Pyaau are responsible for:

  • Maintaining accurate customer information
  • Recording deliveries, collections, and transactions correctly
  • Managing staff access and permissions
  • Verifying balances, outstanding amounts, and reports
  • Complying with applicable tax, invoicing, licensing, and business regulations
  • Resolving disputes with their customers
  • Maintaining appropriate authorization to process customer information

Pyaau provides tools for recording and managing information. We do not independently verify the accuracy of each business transaction.

7. Customer Information and Data Ownership

Businesses retain their rights in information entered into their Pyaau accounts, including customer records, delivery history, and payment information.

By using the Platform, businesses authorize Pyaau to process, store, transmit, and maintain such information as necessary to deliver the subscribed services.

Pyaau will not claim ownership of the business’s customer database.

Businesses are responsible for ensuring that customer information is collected and processed lawfully.

We will not use customer records from one business to provide another unrelated business with access to those records.

8. Staff Accounts and Access

Businesses may authorize employees or representatives to access their accounts where supported by the Platform.

The account owner is responsible for:

  • Assigning appropriate permissions
  • Removing access when employees leave
  • Monitoring activity performed by authorized users
  • Preventing unauthorized sharing of account credentials

Actions performed through authorized accounts may be treated as actions performed on behalf of the subscribing business, subject to applicable law.

9. Service Availability and Maintenance

We aim to provide a reliable and continuously available service.

However, access may occasionally be interrupted due to:

  • Scheduled maintenance
  • Infrastructure or network issues
  • Software updates
  • Third-party service outages
  • Security incidents
  • Events beyond our reasonable control

We do not guarantee uninterrupted or error-free availability unless expressly committed under a separate written service-level agreement.

We may temporarily restrict access when necessary to protect platform security or stability.

10. Data Accuracy and Financial Reports

Pyaau provides business reports and calculations based on information entered by users and the functionality available within the Platform.

Businesses remain responsible for reviewing and verifying reports, outstanding balances, collections, and financial records.

Pyaau is not a substitute for professional accounting, taxation, or financial advice.

We are not responsible for commercial losses caused by inaccurate or incomplete information entered by users, except to the extent liability cannot legally be excluded.

11. Prohibited Activities

Users must not:

  • Access another business’s data without authorization
  • Attempt to compromise Platform security
  • Reverse engineer the software except as permitted by applicable law
  • Use automated systems to overload or disrupt the Platform
  • Upload malicious code or unlawful content
  • Use the Platform for fraudulent transactions
  • Resell or sublicense the Platform without written authorization
  • Violate intellectual property or privacy rights

We may investigate suspected misuse and take appropriate action, including restricting or suspending access.

12. Intellectual Property

Pyaau and its licensors retain ownership of the Platform, including its software, application design, branding, documentation, and related intellectual property.

Subject to these Terms and payment of applicable fees, we grant subscribing businesses a limited, non-exclusive, non-transferable right to access and use the Platform for their internal business operations during the applicable subscription period.

This does not transfer ownership of the software to the subscriber.

Business data entered by users remains subject to Section 7.

13. Third-Party Services

Pyaau may depend on third-party infrastructure, authentication providers, payment gateways, messaging services, and other integrations.

Availability of these integrations may depend on the relevant providers.

Third-party services may be governed by their respective terms and privacy policies.

Additional charges may apply to optional third-party services where disclosed before activation.

14. Suspension and Termination

We may suspend or terminate access where:

  • A subscription expires or required fees remain unpaid
  • A user materially violates these Terms
  • Account activity presents a serious security risk
  • The Platform is used for unlawful or fraudulent purposes
  • Continued service would violate applicable law

Where reasonable, we will provide notice and an opportunity to resolve the issue before suspension, except where immediate action is necessary.

Businesses may request account closure through our support channels.

Following termination, access to the Platform may be discontinued and data handled according to the Privacy Policy and applicable contractual obligations.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Pyaau will not be liable for indirect, incidental, special, or consequential losses, including lost profits or business opportunities, arising from use of the Platform.

Our total aggregate liability arising from the services will generally not exceed the subscription fees paid by the affected business during the 12 months immediately preceding the event giving rise to the claim.

This limitation does not apply to liability that cannot lawfully be restricted or excluded.

Nothing in these Terms excludes statutory rights or remedies that cannot be waived under applicable law.

16. Disclaimer of Warranties

The Platform is provided on an “as available” basis.

While we make reasonable efforts to maintain functionality, security, and reliability, we do not guarantee that every feature will be uninterrupted, free of errors, or suitable for every business requirement.

Businesses are responsible for determining whether the Platform meets their operational needs.

Any specific service commitments agreed separately in writing will take precedence over conflicting general disclaimers in these Terms.

17. Changes to Services and Terms

We may improve, modify, add, or discontinue Platform features.

Where changes materially affect subscribed services, we will provide reasonable notice where practicable.

We may also update these Terms from time to time.

Material changes will be communicated through the website, application, or registered contact information, as appropriate.

Continued use after revised Terms become effective may constitute acceptance where permitted by law. Where affirmative consent is legally required, we will request it.

18. Governing Law and Disputes

These Terms are governed by the laws of India.

The courts having jurisdiction at the location of our registered office in India will have jurisdiction over disputes arising from these Terms, subject to applicable mandatory consumer protection laws and other legal requirements.

Before initiating formal proceedings, both parties are encouraged to attempt to resolve disputes through good-faith communication.
